By accessing, browsing, creating an account, purchasing products (digital or physical), or downloading content from Samanvayam (samanvayam.store), you agree to be bound by these Terms of Service, Digital Usage License, and Conditions of Sale.. If you do not agree to these Terms, do not use the website or purchase/download any products.
1. Eligibility & Acceptance
You represent that you are at least 18 years of age and fully competent to enter into a binding legal contract under the Indian Contract Act, 1872.
If you are accessing or using the site under 18 years of age, you may do so only under the direct supervision of a parent or legal guardian who agrees to be bound by these Terms. These Terms form a legally binding agreement between you and Samanvayam. Continued use of the website or receipt of any product constitutes unconditional acceptance.
2. Intellectual Property & Copyright Ownership
All content hosted, published, or sold by Samanvayam—including physical books, digital publications (PDFs and other formats), spiritual literature, cover designs, graphics, logos, images, typography, site layout, and software—is the exclusive intellectual property of Samanvayam, its authors, or its licensors.
All content is protected under the Copyright Act, 1957 (India) and applicable international copyright treaties. Copyright protection strictly applies to all publications, whether provided for a fee or as complimentary/free digital downloads. You do not acquire any ownership interest, title, or moral rights by purchasing, downloading, or reading our publications. All rights not expressly granted are strictly reserved.
3. Digital Products & PDF Grant of License
When you download or purchase any digital publication from Samanvayam, you are granted a limited, non-exclusive, non-transferable, non-sublicensable, revocable license solely for your personal, private, non-commercial reading.
You expressly agree NOT to:
Distribute: Share, forward, upload, post, transmit, or distribute the digital file (in whole or in part) via email, messaging platforms (WhatsApp, Telegram, Signal, etc.), cloud storage, torrents, file-sharing sites, or social media.
Commercially Exploit: Sell, rent, lease, sublicense, charge for access, or monetise the file or its content in any manner.
Alter Content: Modify, redact, edit, translate, adapt, alter, or create derivative works based on our content.
Extract Assets: Copy, scrape, extract, or isolate text, graphics, illustrations, or formatting from the document.
Circumvent Security: Remove, alter, or bypass copyright notices, digital watermarks, download count limits, or expiration windows.
License Termination & Technical Security. Breach of this license immediately and automatically terminates your license to use the file, and you
must permanently delete all copies in your possession or control.
Technical Monitoring: To protect our intellectual property, digital download links may be subject to security controls, time limits, and embedded
watermarks. Technical logs (including IP addresses, timestamps, and download records) are maintained to verify license compliance and prevent unauthorized distribution.
4. Physical Books & Products
Order Processing & Title: Physical books and tangible products are sold subject to these Terms. Title and risk of loss pass to you upon delivery of the items to our logistics/courier partner.
Delivery Timelines: Shipping and delivery timelines provided at checkout are estimates only. Samanvayam is not liable for courier delays, transit disruptions, or events beyond our reasonable control (force majeure).
5. Orders, Pricing, and Delivery
Pricing & Availability: Prices, descriptions, and stock availability for physical books and digital products are subject to change without prior notice. Applicable Goods and Services Tax (GST) or statutory taxes are calculated and charged at checkout.
Digital Delivery: Download links are generated upon successful order completion or payment verification. Links are subject to security parameters, including expiration periods and download count limits. You are responsible for downloading and securely storing the file within the permitted period.
Order Discretion: We reserve the right to refuse, cancel, limit, or terminate any order or account at our sole discretion at any time.
6. Strict Policy: Refunds, Returns & Cancellations
A. All Sales Are Final (Strict No Refund / No Return Policy)
Digital Goods: Due to the immediate delivery, digital nature, and instant copy capability of digital files (PDFs), all digital sales are final, non-cancellable, and non-refundable once a download link has been generated or delivered.
Physical Books: All sales of physical books are final. We maintain a strict No Return and No Refund policy for physical orders once placed and processed. We do not offer returns or exchanges for change of mind or buyer's remorse.
B. Case-by-Case Exceptions (Discretionary Review)
We take pride in the quality of our publications. While our default policy is strictly non-refundable:
Eligible Issues: If you receive a physically damaged book, a printing/binding defect (e.g., missing or blank pages), an incorrect title shipment, or encounter an unreadable digital download file, you may contact our support team at support@samanvayam.store within 7 days of delivery or download.
Required Evidence: You must provide clear supporting evidence (order details, descriptions, and photographs/videos of the damage or printing defect).
Discretionary Resolution: Requests will be evaluated strictly on a case-by-case basis at Samanvayam's sole discretion. In valid cases, we may offer a replacement physical copy, a re-issued digital link, or an appropriate resolution. Decisions made by Samanvayam regarding such requests are final.
Failure to Notify: Failure to notify us within the 7-day period or failure to provide requested proof will result in automatic decline. This limited review process does not constitute a general right of return or refund.
7. Limitation of Liability & Disclaimers
A. "As-Is" Provision
To the maximum extent permitted by applicable law, all website services, physical products, and digital publications are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
B. Content Disclaimer
Content published by Samanvayam (including spiritual, cultural, and literary works) is provided for general informational, educational, and reading purposes only and does not constitute professional, legal, medical, or financial advice.
C. Limitation of Damages & Liability Cap
Samanvayam, its proprietor, authors, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, profits, or goodwill) arising out of or related to your use of or inability to use our products or website.
Maximum Cumulative Liability: In any event, Samanvayam’s total cumulative liability for any claim or dispute arising out of or related to any product or transaction shall never exceed the actual amount paid by you for the specific product giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded under Indian law (including liability for death or personal injury caused by gross negligence, or liability arising from intentional fraud).
8. User Conduct & Indemnity
You agree to use the website and our publications strictly for lawful purposes. You agree to indemnify, defend, and hold harmless Samanvayam, its proprietor,
authors, and operational partners from and against any claims, liabilities, losses, damages, costs, or legal expenses arising out of:
- Your breach of these Terms or the Digital Usage License.
- Unauthorised distribution, forwarding, or reproduction of our digital or physical content.
- Your misuse of the website or violation of any third-party rights.
9. Suspension & Termination
We reserve the right to suspend or terminate your account, cancel orders, or revoke digital licenses immediately, without prior notice, if you breach these
Terms or if we suspect unauthorized file distribution or fraudulent activity. Upon termination, your right to use our services ceases, and you must permanently
destroy all digital copies of our publications in your possession.
10. Modifications to Terms
We reserve the right to modify or update these Terms at any time. The revised version will be posted on this page with an updated "Last Updated" date. Your continued access to the website or purchase of products following posted changes constitutes your binding acceptance of the updated Terms.
11. Governing Law & Exclusive Jurisdiction
These Terms and any non-contractual obligations or disputes arising out of them shall be governed by and construed in accordance with the laws of India.
Any legal action, suit, or proceeding arising out of or related to these Terms, our digital licenses, or product purchases shall be subject to the exclusive jurisdiction of the competent courts located in Hyderabad, Telangana, India.
